1. Acceptance of Terms
By accessing or using the Lovely Sweets website and platform available at lovelysweetsgwalior.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
These Terms apply to all visitors, registered customers, and any other users of the Platform. Lovely Sweets reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
2. About Us
Lovely Sweets is a traditional Indian confectionery business established in 1960, operating under the philosophy of "Anokhi Parampara Ka Swad" (The Taste of Unique Tradition).
We operate multiple shop locations in Gwalior, Madhya Pradesh, India, and offer online ordering and home delivery within Gwalior city limits through this Platform.
3. Eligibility
To use this Platform and place orders, you must meet the following eligibility criteria:
- Be at least 18 years of age, or be using the Platform under the supervision of a parent or legal guardian.
- Provide accurate, complete, and current information during registration.
- Have a valid email address capable of receiving verification messages.
- Reside within or be placing a delivery order to an address within Gwalior city limits, as validated by our delivery boundary system.
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if we believe a user does not meet these eligibility criteria.
4. Account Registration and Security
To place an order, you must register for an account using your email address. Account creation requires verification via a One-Time Password (OTP) sent to your registered email.
You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your password with any third party and to notify us immediately if you become aware of any unauthorised use of your account.
You are solely responsible for all activity that occurs under your account. Lovely Sweets will not be liable for any loss or damage arising from your failure to keep your credentials secure.
We reserve the right to suspend or terminate your account if we suspect any unauthorised, fraudulent, or abusive activity.
5. Orders and Delivery
5.1Service Area
Online delivery is available exclusively to addresses within Gwalior city limits. Your delivery address is validated against our service boundary at the time of checkout. We reserve the right to cancel any order placed for an address outside our delivery area.
5.2Minimum Order Quantity
A minimum order quantity of 1 kg applies per product. Orders that do not meet this requirement cannot be placed.
5.3Order Verification
All online orders are subject to manual verification by our shop staff, who may contact you by phone to confirm your order before it is accepted into preparation. If we are unable to reach you, or if we determine that an order cannot be fulfilled, we reserve the right to cancel the order and notify you by email.
5.4Delivery Charges
Delivery charges are calculated based on the road distance from our reference point (Kila Gate, Gwalior) to your selected delivery address. Orders within the base delivery radius are charged a flat fee. Orders beyond the base radius incur an additional per-kilometre charge. The applicable delivery charge is displayed clearly at checkout before payment is required.
5.5Delivery Timeframes
Estimated delivery times are indicative and not guaranteed. Delivery timelines may be affected by order volume, traffic conditions, festival seasons, or other factors outside our control. We will make reasonable efforts to communicate any significant delays.
5.6Order Cancellation
You may cancel your order at any time before it has been accepted and confirmed by our shop staff. Once an order has been confirmed, it cannot be cancelled through the Platform. For post-confirmation cancellations, please contact us directly.
6. Pricing and Payments
All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
Prices are subject to change without prior notice. The price applicable to your order is the price displayed at the time of checkout confirmation.
- Online payment via Razorpay: supports UPI, credit cards, debit cards, net banking, and digital wallets.
- Cash on Delivery: where payment is collected at the time of delivery.
For online payments, your transaction is processed securely by Razorpay. Lovely Sweets does not store your card details or banking credentials on our servers.
In the event of a payment failure, your order will not be confirmed. Please retry the payment or choose Cash on Delivery.
Refunds for cancelled online-payment orders will be processed through the original payment method within 5 to 7 business days, subject to Razorpay's refund processing timelines.
7. Products
We make reasonable efforts to display product images and descriptions accurately. However, actual products may vary slightly in appearance due to the handcrafted nature of traditional Indian sweets.
Product availability is subject to stock levels at the time of order placement. If a product becomes unavailable after your order is confirmed, we will contact you to offer an alternative or process a refund.
Our products are food items intended for consumption within the shelf life indicated on the packaging or communicated at the time of delivery. We are not responsible for any adverse effects resulting from consumption after the indicated shelf life or improper storage after delivery.
8. Intellectual Property
All content on the Platform — including but not limited to the Lovely Sweets name, logo, slogan ("Anokhi Parampara Ka Swad"), product images, descriptions, design elements, and software — is the intellectual property of Lovely Sweets and is protected under applicable Indian intellectual property laws.
You may not copy, reproduce, distribute, or commercially exploit any content from the Platform without our prior written permission.
9. Prohibited Conduct
You agree not to engage in any of the following prohibited behaviors:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
- Place fraudulent, false, or speculative orders.
- Impersonate any person or entity or misrepresent your affiliation.
- Attempt to gain unauthorised access to any part of the Platform, its servers, or any connected systems.
- Interfere with or disrupt the integrity or performance of the Platform.
- Use automated scripts, bots, or scrapers to access the Platform.
- Engage in any conduct that could damage the reputation of Lovely Sweets.
10. Third-Party Services
The Platform integrates with third-party services including Razorpay (payments) and Google Maps (address validation and distance calculation).
Your use of these services through our Platform is subject to their respective terms of service and privacy policies. We are not responsible for the practices, availability, or content of these third-party services.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Lovely Sweets shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to loss of profits, loss of data, or service interruptions, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount paid by you for the specific order giving rise to the claim.
12. Disclaimer of Warranties
Provided "As Is" & "As Available"
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Gwalior, Madhya Pradesh, India.
